Guardianship and Alternatives: Planning for Age of Majority Decisions for Youth with IEPs

What is guardianship? At 18, a child reaches the “age of majority” and is considered an adult. This means they can make legal, educational, health and other decisions for themselves. Guardianship is a legal proceeding in court that gives the power
for such decisions to another individual, sometimes a parent, on behalf of an individual with a disability. Because guardianship deprives an individual of their rights and often makes them more, not less, vulnerable, it should
be considered with caution and only used when necessary. For that reason, it is important to look at alternatives to guardianship as well. This session will provide information about guardianship and alternatives for youth with disabilities and their families.
